Abstract: The sensational Swiss trial of Chinese Novel Rou Pu Tuan in the late 1950s can be defined as a primordial event in the emergence of Chinese literature in Germany after World War II. This paper analyses the elements of this event and its influence on Li Yu's canonization, in order to show that the relationship between defender and court is a hidden communication structure in sinological scholarship. The sinologists fulfill the dual function of defender/judge, swinging between the two identities according to concrete occasions. It, therefore, reveals a fact that whether Chinese literature can enter the Western knowledge system is not determined by individual literary objects, nor by individual translators, but by structural requirements of the system itself. Structural imperatives go beyond all subjective will and are often expressed in the form of accidental events.
